How the best resignation date is worked out

Your last working day is your resignation date plus your notice period. Several things you've earned only pay out if that last day falls on or after a particular date, so resigning a few weeks too early can cost more than a month's salary. This tool lists those dates, works out what each is worth, and finds the resignation date that keeps the most money once you account for what waiting costs you at the new job.

Gratuity is the biggest one. Permanent employees qualify after 5 years of continuous service; since the Code on Social Security took effect on 21 November 2025, fixed-term employees qualify after 1 year and are paid proportionately. The amount is 15 days of last-drawn basic (plus DA) for every year of service, on a 26-day month, with a part year of more than six months counted as a full year. Gratuity is tax-free up to ₹20 lakh. Some High Courts have accepted 4 years and 240 working days as enough, but the question isn't settled, so this tool treats your 5-year anniversary as the safe date and flags the year before it as a grey zone.

Bonuses often require you to be on the payroll on the payout date. ESOPs and RSUs vest only if you're still employed on the vesting date — and remember that vested options usually have to be exercised within a short window after you leave. Leave encashment keeps growing while you work; on leaving, it's tax-free for non-government employees up to a lifetime limit of ₹25 lakh.

On the other side, every month you delay costs you the extra pay you'd earn at the new job. The tool compares each candidate date — resign now, or just late enough to reach each milestone — and recommends the one with the best net result. Your inputs never leave your browser. Always confirm the exact rules in your offer letter, bonus policy and ESOP plan before you resign.

Frequently Asked Questions

What is the best date to resign in India?
The best date is the earliest one whose last working day still lands after the money you would otherwise forfeit: a bonus that requires you to be on the payroll on the payout date, an ESOP tranche about to vest, or the date you become eligible for gratuity. Because your last day is your resignation date plus the notice period, you usually need to resign one notice period before each milestone.
How many years of service are needed for gratuity?
Permanent employees need 5 years of continuous service under the gratuity law. Since the Code on Social Security took effect on 21 November 2025, fixed-term employees become eligible after 1 year and are paid proportionately. Gratuity is 15 days of last-drawn basic (plus DA) for every year of service, using 26 working days a month; a part year of more than six months counts as a full year.
Is 4 years and 240 days enough for gratuity?
It is a grey area. Some High Courts, including Madras and Kerala, have accepted 4 years plus 240 working days in the fifth year as enough, but the Supreme Court has not settled the question and many employers apply the full 5 years. If you are close, the safe choice is to make your last working day fall on or after your 5-year anniversary.
Do I lose my bonus if I resign before it is paid?
Often yes. Many company bonus policies require you to be on the payroll, sometimes not even serving notice, on the payout date. Check your bonus policy or offer letter for the eligibility condition, and enter the payout date in the calculator to see what it is worth to wait.
Is leave encashment taxable when I resign?
For non-government employees, leave encashment received on leaving a job is tax-exempt up to a lifetime limit of ₹25 lakh (raised from ₹3 lakh in 2023), subject to the other conditions in the law; any excess is taxed as salary. Government employees' leave encashment on retirement is fully exempt.
